LHDN has recently released a clarification to address uncertainties regarding stamp duty for employment contracts. Here’s what you need to know:
🔎 Stamp Duty Application by Contract Date:
💰 Stamping Fees & Late Penalties
- Stamping fee: RM10 per contract
- Late penalties (from 1 Jan 2026 onward):
- Within 3 months from contract date: RM50 or 10% of duty (whichever is higher)
- After 3 months from contract date: RM100 or 20% of duty (whichever is higher)
- Submission deadline of new employment contract: Within 30 days from contract signing
💰✅ What Should You Do Now?
Contracts signed from 1 Jan 2025 onwards:
➤ Stamp your contracts now. RM10 applies, penalty is waived for 2025.
Contracts signed before 1 Jan 2025:
➤ Stamping is still required, but both stamp duty & penalty are exempted.
