What Are the Key Changes?
The new guidelines categorize employment contracts and exemptions into three distinct groups. Here is what you need to know:
1. Full Exemption for Salaries RM3,000 and Below
Under the updated First Schedule of the Stamp Act 1949, any employment contract where the monthly salary is RM3,000 or less is now fully exempt. These documents do not need to be stamped or endorsed by HASiL.
2. Streamlined Process for Salaries Above RM3,000
For employees earning a monthly salary exceeding RM3,000, HASiL has simplified the requirements:
Principal Contract: Only the main or “master” contract containing the core terms and conditions of employment must be stamped and endorsed.
Ancillary Documents: Any secondary or supporting documents related to the same employment (such as letters of offer or supplementary agreements) no longer require separate stamping or endorsement.
3. Mandatory Endorsement for General Exemptions (Section 35)
While certain instruments fall under the General Exemption category (Section 35 of the Stamp Act 1949), they are not automatically cleared. These instruments must still be submitted for endorsement to verify that the specific party and document are legally eligible for the exemption.
